Terms and Conditions
Legal information
1. Scope
These Terms and Conditions apply to all orders placed through the online shop on sidritvokshi.com. They apply to consumers and businesses. Mandatory consumer protection rights remain unaffected.
2. Contracting party
The contracting party is SIDRIT VOKSHI, Kranzgasse 4, 1150 Vienna, Austria, e-mail: office@sidritvokshi.com.
3. Offer, order and contract conclusion
Product presentations in the online shop are a non-binding invitation to order. Before submitting an order, checkout entries can be reviewed and corrected. A binding contract is concluded when the order is completed and confirmed in the Shopify checkout or when we expressly accept the order. Automatic receipt confirmations only confirm receipt unless expressly stated as acceptance.
4. Products, sizes, colours and availability
Product images are illustrative. Minor deviations in colour, print placement, material appearance or display may occur for technical reasons. Availability, sizes and variants are shown in the relevant product offer and checkout. If a product is unavailable after ordering, we will inform customers without delay and refund payments already made.
5. Prices, taxes and shipping costs
Prices are shown in euros. Due to the small business exemption under § 6(1)(27) Austrian VAT Act, VAT is not charged or shown. Shipping costs, customs duties or import charges are displayed in checkout where they can be calculated. Deliveries outside the EU may incur additional charges borne by customers.
6. Payment and checkout
Available payment methods are shown in the Shopify checkout. Payment is processed by the payment providers integrated there. Payment data is processed in encrypted form; as a rule, we do not receive full credit-card or payment details.
7. Delivery and acceptance
Delivery is made to the address entered in checkout. Delivery times are estimates unless a binding delivery date has been expressly promised. Delays due to production, availability, public holidays, customs, shipping providers or force majeure may occur. Customers must provide complete and correct delivery data.
8. Retention of title
Goods remain our property until full payment has been made.
9. Right of withdrawal
Consumers generally have a statutory fourteen-day right of withdrawal. Details, deadlines, consequences and the model withdrawal form are provided in the withdrawal policy on this website. Customers bear the direct cost of return shipping unless expressly agreed otherwise.
10. Exceptions to withdrawal
The right of withdrawal may be excluded by law, in particular for goods made to customer specifications, clearly personalised goods, sealed goods unsuitable for return for hygiene or health protection reasons once unsealed, or unsealed audio, video or data carriers.
11. Warranty
Statutory warranty rights apply. These Terms do not restrict mandatory consumer rights. For business transactions, statutory rules apply unless mandatory law provides otherwise.
12. Liability
We are fully liable for damage arising from injury to life, body or health and for damage caused intentionally or by gross negligence. In cases of slight negligence, liability applies only as required by mandatory law. Liability for external links exists only where legally required.
13. Contract language, storage and technical steps
The contract language is German. Translations on this website are provided for convenience. The contract text is not stored by us in a separate customer-accessible contract system; order information is provided in checkout and in the order confirmation.
14. Data protection
Information on personal data processing is provided in the privacy policy on this website.
15. Dispute resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board unless a statutory obligation applies.
16. Applicable law
Austrian law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rights of the customer's country of habitual residence remain unaffected.
17. Severability
If individual provisions of these Terms are or become invalid, the remaining provisions remain effective. The statutory rule applies in place of the invalid provision.
